[CloudJoi White Valentine's Day Giveaway] Terms & Conditions

Eligibility:

The "White Valentine's Day Giveaway” ("The Giveaway") is organized by CloudTheatre Sdn Bhd (CloudJoi) ("The Organizer") and shall be held from 20th February 2024 to 5th March 2024 (“Giveaway Period”).
The Organizer may, at its sole and absolute discretion, extend the Giveaway Period at any time. The Organizer reserves the right to do so without any prior notice. Unless an Extended Period is announced, any entries received after the last day of the Giveaway period (due to any reason howsoever and/or whatsoever arising) shall be disqualified. Any participation in the Giveaway during the Extended Period (if any) shall be governed by these terms and conditions ("Terms and Conditions"), which shall remain in full force and effect.
The participants are not eligible to participate in the said Giveaway: a. Permanent and/or contract employees of the Organizer (including its subsidiaries and related companies), including but not exclusive to their respective immediate family members, meaning parents, spouses, children and siblings;
Representatives and/or agents (including advertising agents and Giveaway management agents) of the Organizer, including but not exclusive to their respective immediate family members, meaning parents, spouses, children and siblings.

The Giveaway Mechanism:

To enter the Giveaway, participants need to follow @cloudjoi_ on Instagram, tag their partner and provide their most creative first date idea in the comment section of the Giveaway post. Additionally, they should share the Giveaway post to their Instagram stories. All posts must be made public for eligibility.
Participants may submit as many completed entries as they wish during the Giveaway Period.
The Organizer takes no responsibility or assumes no liability for the comments and/or content that participants may post. Participants are solely responsible for the consequences of posting and publishing their comments and/or contents.
The Organizer may, in its sole discretion, disqualify any entry that the Organizer considers to have been in breach of these terms and conditions. This includes, but is not limited to, failure to meet Giveaway eligibility criteria or entries that contain obscene, libelous, racially disparaging, defamatory, harassing, threatening, or unlawful content.
The Organizer will not be responsible for entries that cannot be processed due to technical or operational reasons. Entries that are lost, misdirected, incorrect, incomplete, or illegible, for any reason whatsoever, will be disqualified.
A panel of judges, which includes representatives of the Organizer, will review the entries for the participants. The winner will be selected based on the most creative first date idea submitted. The selected winner will receive x2 BoboKL show tickets for ‘SHARIZAN BORHAN Swings Again!’ on 14 March 2024, at 8:00 PM, and x1 bouquet of flowers. The decision of the judging panel is final, and no correspondence will be entertained.

Prizes:

A single qualified winner, selected by a panel of judges during the Giveaway Period, will receive only one (1) prize. The prize, fully sponsored by CloudTheatre Sdn Bhd (CloudJoi), includes x2 BoboKL show tickets for "SHARIZAN BORHAN Swings Again!" on 14 March 2024, at 8:00 PM, and x1 bouquet of flowers.
Entries for each qualifying participant must be submitted within the respective qualifying date. Otherwise, the entry will be disqualified. The Organizer may at its sole discretion amend, change or extend the qualifying dates for any of the qualifying weeks.
The Giveaway, which ends on 5th March 2024, at 11:59pm, will be followed by private contact with the winner. Prior to publicly announcing the winner on 9th March 2024, the Organizer will privately message the winner to confirm their acceptance through our Instagram direct messages (DM). The winner should confirm within 24 hours after being privately notified of their win. Failure to respond within this timeframe will lead to the selection of an alternative winner.
Only participants who fulfill the Giveaway Mechanism stated above shall be eligible to win the Prize. Incomplete entries and/or Participants that fail to fulfill the Giveaway Mechanism will automatically be disqualified from the Giveaway without notice.
The Organizer reserves the right to substitute any of the Prizes with that of similar value at any time at their absolute discretion without prior notice and all Prizes are non-transferable to another individual and absolutely non-negotiable.
In the event that, for any reason whatsoever, the Winner is unable to attend the ‘SHARIZAN BORHAN Swings Again!’ show on 14 March 2024, at 8:00 PM, to collect the winning prize (x2 BoboKL show tickets and x1 bouquet of flowers) within the stipulated time period, the Organizer shall not reimburse or compensate the Winner. The Organizer is not obliged to provide an extension notice for the Prize Collection Period. All unclaimed Prizes after the Collection Period will be forfeited. The Organizer reserves the right to select an alternative winner to attend the show and receive the flowers.
All Prizes are given on an "As Is" basis and are not exchangeable, transferable, or redeemable for cash, credit, other items, or voucher, in part or in full.
The Organizer makes no warranties or representations whatsoever with respect to the Prizes and shall not be responsible nor liable for any problems and/or damage there to or arising there from.
The Organizer will not assume liability if the Winner cannot be reached within 24 hours of receiving a private message via Instagram direct messages (DM) notifying them of their win, prior to publicly announcing the winner on 9th March 2024. Should the Organizer be unsuccessful in contacting the Winner after a minimum of three (3) attempts, they will not be held responsible.
The Organizer reserves the right to appoint a third party to conduct the verification of the Winner and to fulfill the delivery of prizes. The Winner is required to agree that the Organizer may provide all necessary information of the Winner to such third parties to facilitate such service.
The judges' decisions are final, and no correspondence thereon will be entertained.
Prizes must be claimed online. Identification, which includes the social media account name of the Winner, will be required. In the event of the Organizer being requested to post/courier a Prize to a Winner, the Organizer will not be held liable for non-receipt of the Prize or damages caused during the delivery process. No replacement and/or exchange of Prize will be entertained.
The Organizer reserves the right to forfeit the Prize of any Winner who does not provide the required details as stipulated in the Giveaway Terms and Conditions.
Under special circumstances and subject to the absolute discretion of the Organizer, a Winner may not nominate a designated representative to collect the Prize.
All Prizes are accepted entirely at the risk of the Winner, and the Organizer excludes all warranties concerning any Prize to the extent permitted by law.
By participating in this Giveaway, the Winner agrees to participate in any video shoot and photo shoot arranged by the Organizer for promotional purposes related to the Giveaway. The Winner must adhere to the terms outlined in the video and photo shoot agreement provided by the Organizer. Failure to comply with this requirement may result in disqualification, and an alternative winner may be selected.

Other Terms & Conditions:

Participants and the Winner shall bear full liability and responsibility in case of any mishap, injury, damage, claim, or accidents [including death] resulting from their participation in the Giveaway, redemption, and/or utilization of the prizes. They agree to release and hold the Organizer and its Prize partners free and harmless from any liability.
All transportation, accommodation, personal costs, and/or any other expenses incurred to participate in the Giveaway and to redeem the Prize are the sole responsibility of the Participant(s) and/or Winner(s).
The Organizer reserves the right to use the names and/or photographs of the Participants as materials for advertising, trade, and/or publicity without prior notice to the Participants. Participants shall not be entitled to claim ownership or other forms of compensation for the materials.
By participating in the Giveaway, Participants give their consent to and authorize the Organizer to disclose their particulars to third-party service providers and/or partners engaged by the Organizer for purposes of the Giveaway and/or any customer survey in understanding Participants' purchasing behavior.
The Organizer’s decision on all matters relating to the Giveaway shall be final and binding, and no further correspondence or attempt to dispute such decisions will be entertained.
The Organizer reserves the absolute right to change, amend, delete, or add to the Giveaway Terms and Conditions without prior notice at any time. Participants agree to be bound by all Terms and Conditions.
By participating in this Giveaway, Participants agree to be bound by the Terms and Conditions of the Giveaway and the decisions of the Organizer.
An individual who participates in the Giveaway may be required to submit personal or confidential information about themselves (including, but not limited to, name, telephone number, e-mail address, or any other such information) ("Personal Information") to the Organizer. The Organizer will treat any Personal Information obtained from an individual who participates in the Giveaway in accordance with the Legislation on the Protection of Personal Data Policy.
This Giveaway is organized by CloudTheatre Sdn Bhd (CloudJoi) and Instagram is released by each entrant and participant of the said Giveaway.
By joining this Giveaway, you also acknowledge that this Giveaway is organized by CloudTheatre Sdn Bhd (CloudJoi). Instagram is released by each entrant and participant of the said Giveaway, acknowledging that the promotion is not sponsored, endorsed, or administered by, or associated with Instagram.
